Terms of Service

Read this first — SABRE is a situational-awareness aid, NOT a navigation system. SABRE is not a certified aviation device, is not a source of primary flight guidance, and must never be used as the basis for navigation, terrain or traffic avoidance, weather penetration, or release decisions. Data presented may be delayed, incomplete, or wrong. The pilot in command (or ground commander) retains sole responsibility for the safe conduct of every operation. By using SABRE you agree to this as a binding term, not merely a notice.

1. Acceptance

These Terms govern your use of the SABRE service (the hosted server at this site, the SABRE Node software, and related downloads — together, the "Service"), provided by GreyCliff Industries Inc. ("GreyCliff"). By creating an account, checking the acceptance box at registration, installing the software, or using the Service, you agree to these Terms on your own behalf and on behalf of the organization you represent.

2. The Service

SABRE aggregates publicly available and third-party data feeds (aircraft and vessel positions, weather, airspace notices, fire information, and similar) into an advisory operating picture, and provides mission-planning calculations. All outputs are estimates for planning and awareness. GreyCliff does not warrant the accuracy, timeliness, or completeness of any data or computation.

3. Accounts and eligibility

You must provide accurate registration information and keep your credentials secure. Accounts are approved at GreyCliff's discretion and are for professional use by you and your organization. You are responsible for activity under your account and for the nodes you enroll.

4. Trials, subscriptions, and payment

New accounts begin with a 30-day evaluation period unless otherwise agreed in writing. After the evaluation, continued use requires an active plan. Fees, plan limits (such as node counts), and renewal terms are stated at purchase. Fees are non-refundable except as required by law or expressly agreed. GreyCliff may suspend accounts with lapsed plans; your data-handling rights on termination are described in Section 8 and the Privacy Policy.

5. Acceptable use

You will not: use the Service where certified equipment is required; resell or provide the Service to third parties outside your organization without written agreement; probe, disrupt, or overload the Service; attempt to access other customers' data; or use the Service in violation of law, including export-control and sanctions law. Custom spokes you install run on your own node at your own risk.

6. Your content — missions, sharing, and chat

Mission data you build on a node stays on that node unless you explicitly share it. When you share a mission to a group or send messages, that content is stored on the server and visible to the group or recipients you chose. You retain ownership of your content and grant GreyCliff a limited license to store and transmit it solely to operate the Service. Deleting a group deletes its shared missions and messages.

7. Software license

GreyCliff grants you a non-exclusive, non-transferable license to install and use the SABRE Node software for your professional use during an active plan, subject to the installer EULA. All rights not granted are reserved. Spokes you author are yours; the SABRE SDK is provided to encourage them.

8. Termination

You may stop using the Service at any time. GreyCliff may suspend or terminate accounts for breach of these Terms. On termination, enrollment credentials are revoked; content you shared to the server is deleted in the ordinary course as described in the Privacy Policy. Sections 9–12 survive termination.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF DATA, OR UNINTERRUPTED OPERATION. THIRD-PARTY DATA SOURCES MAY FAIL OR BE WRONG AT ANY TIME.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) GREYCLIFF SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF LIFE, INJURY, OR PROPERTY DAMAGE ARISING FROM OPERATIONAL DECISIONS MADE IN RELIANCE ON THE SERVICE — SUCH DECISIONS REMAIN THE SOLE RESPONSIBILITY OF THE OPERATOR; AND (b) GREYCLIFF'S TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You will defend and hold harmless GreyCliff from claims arising out of your operations, your use of the Service contrary to these Terms, or content and spokes you create or share.

12. Export control

The software and Service may be subject to U.S. export-control laws, including the Export Administration Regulations. You represent that you are not located in, or acting on behalf of, an embargoed jurisdiction or prohibited party, and you will not export or re-export the software contrary to law.

13. U.S. Government use

The SABRE software is "commercial computer software" and documentation is "commercial computer software documentation" (FAR 12.212 / DFARS 227.7202), developed exclusively at private expense. Government users acquire only the rights granted to all customers under these Terms and the applicable license. Use by government personnel is subject to the operating authorities and risk-acceptance processes of the acquiring organization; nothing in the Service substitutes for those authorities.

14. Changes

GreyCliff may update these Terms; material changes will be posted with a new version number and, for account holders, notice at sign-in. Continued use after notice is acceptance.

15. Governing law

These Terms are governed by the laws of the State of Ohio, excluding conflict-of-law rules. Exclusive venue lies in the state and federal courts of Ohio.
